Abstract
Kendi dönemlerinin tanıklığını yapmakta ve günümüz toplumuna geçmişin
birikimini aktarmakta olan kültür varlıkları ile sağlıklı ve dengeli bir çevrede yaşama
hakkının gerçekleşmesinde temel taşlardan birisi olan tabiat varlıkları, uluslararası ve
ulusal düzeyde korunmaktadır. Kültür ve tabiat varlıklarının korunması ve Anayasanın
63. maddesinin hayata geçirilmesi hususunda idarenin sahip olduğu araçlardan birisi de
koruma amaçlı imar planlarıdır. Bu çalışmada, kültür ve tabiat varlıklarının korunması
hususunda çok önemli olan koruma amaçlı imar planlarının yapılış usulü, Danıştay
kararları ışığında incelenecektir.
Cultural properties are witnesses of their epochs, likewise they transfer the cultural and historical accumulation to today’s society and natural properties are one of the keystones in the realization of the right to live in a healthy and balanced environment. Therefore, they are under protection at national and international levels. One of the instruments that the administration has, is the reconstruction plan for protection with the objective to protect cultural and natural properties and to be implemented 63th article of the Turkish Constitution. In this present study, the procedure of the reconstruction plan for protection which is very important for protection of cultural and natural properties, will be explained in consideration of State Council decisions.
